Manhattan: free for orders
over $150. Orders less than $150 carry a $12.75 fee.
Other boroughs: please call 212.473.2323 for more information.
We deliver Monday to Friday, 10
am to 7 pm. Please call for information on Saturday
deliveries. We cannot guarantee a precise delivery time,
but we
will do our best
to accommodate requests. Please advise if a
delivery
is being made to a business address.
Shipping:

Shipping Notice:
Any wine sold to you from Italian Wine Merchants is sold
in New York and title passes to you, the buyer, in New York.
The buyer is solely responsible for shipment of wine. We
make no representation concerning your legal rights to ship
or receive wine into any state outside New York. In fact,
there are certain states we cannot ship to. By placing an
order, you authorize us to act on your behalf to engage
a common carrier to deliver your order to your selected
destination. You must be 21 years or older to buy wine.
By placing your order with Italian Wine Merchants you certify
under penalty of perjury that you and the recipient are
at least 21 years old. When the wine is delivered, the recipient
will be required to show identification proving that he
or she is at least 21 years old.
Product Availability:
Products on the web site may or may not reflect
the current store inventory. Availability is limited to
stock on hand. Pricing is subject to change. If you
do not
see
an item
on our site, please call Italian Wine Merchants directly
at 212.473.2323. We may be able to place a special
order
for you.
Errors:
Italian Wine Merchants is not responsible for errors or omissions.
Prices are subject to change due to availability and issue
date. These terms apply to all
sales and are the basis upon which orders are accepted.
They will apply to all future transactions unless stated otherwise
in writing.
Prices:
Unless the contrary is shown, prices on this site are:
Per case or per bottle (bt) as indicated.
Exclusive of delivery charges and taxes, if applicable.
Provisional and subject to our confirmation, upon acceptance
of order.
Payment:
Payment is due on
invoice, in US Dollars, and may be made by bank transfer
and most major
credit cards.
Title and Risk:
We shall retain title to all goods (other than goods in
your direct physical possession following delivery or collection
and payment in full for those goods) sold by us until all
the sums due from you in respect of any order have been
paid. Risk in all goods shall pass to you as soon as we
notify you that they are available and earmarked under your
order. If goods within our ownership are held by any third
party on your behalf, you will upon our request instruct
that third party to hold the goods to our order.
Collection:
Any indication as to when wines will be available for delivery
or collection is an estimate only and is not intended to
be binding. We will notify you once wines are available
and you must give at least 48 hours notice before collection.
We shall be entitled to claim a storage and administration
charge (at the rate of charge indicated) for goods which
have not been collected/delivered within three months of
being available.
Force Majeure:
We shall not be liable for any failure to meet our obligations
occasioned by circumstances beyond our reasonable control.
Orders:
The placing and accepting of oral orders shall form a contract
on these terms, conditional upon our written confirmation
of order which may be by the delivery of an invoice.
Law:
All our contracts are subject to US law and shall be interpreted
by the courts located in New York.
